Damaged New Motorcycle

I bought a brand new motorcycle on eBay from Moline Illinois. It was shipped to me in the factory steel crate. I arranged to pick it up at ESTES facility in Portland. When I got notice it had arrived I hired a UHAUL truck, took 1/2 day vacation from work, and went out there. Upon the crated bike being put on the truck I saw the lower part of crate was severely damaged. ESTES guided me to "reject" the shipment and complete a claim. Separately ESTES arranged an independent inspection which showed the damage as well as gave a detailed report. I was told by ESTES people that "ESTES will pay for damage".
Some weeks later I get a decline email from ESTES with a range of pathetic reasons ranging from "the tires were dirty" to "the bike was used". They ignored the facts entirely including their own damage assessment, the formal quote from the motorcycle dealer to make repairs, the fact that the bike was and still is Brand new with 1 mile showing etc., the eBay listing confirming new, and their own staff who guided me to reject the bike.

Happy to forward pictures, emails and the damage report to interested parties in the interests of protecting innocent public like me.
