Montway was not able to reach the driver/dispatch when I need them to contact to avoid the toll charges. Now to dispute EZ Pass team asked towing agreement but they are not able to give. So I end up in paying $150 out of pocket. I asked for refund from Montway but their part of the response is - By way of Federal Law via the Carmack Amendment to the Interstate Commerce Act, the actual carrier is the only one responsible for damage to the vehicle as they had it in their possession. Montway is the broker and under the Carmack Amendment to the Interstate Commerce Act brokers are not liable for damage caused to a vehicle by the carrier. A broker is a person or an entity that, for compensation, arranges, or offers to arrange, for the transportation of property by a motor carrier. A broker does not transport the property and does not assume responsibility for the property. A claim for cargo loss and damage must be filed with the appropriate motor carrier, which usually would be the originating carrier responsible for transporting and delivering the freight or the carrier causing the loss and/or damage to the freight. Extremely disappointed with these responses

Srinivasan, we apologize that our responses have been unsatisfactory to you, however, those responses have been the same we provide to all customers in your position. Sadly this is a common occurrence and that is why we do our best to inform you prior to transport to remove all toll transponders from your vehicle. Although toll companies charge you in a multitude of ways, this is not the fault of the carrier or us here at Montway. None the less, our claims team has helped provide all the documentation needed in cases like yours. The documentation you are requesting is not something we have ever provided to toll companies, as that is a contract between the carrier and Montway. The bill of lading we provided is your contract with the carrier to move your vehicle, and this reflects all the information needed to combat your toll charges.
