DAS destroyed my brand new, $46325 vehicle!

I hired DAS to ship my brand new, $46325 car from Charlotte, NC to Portland, OR on 4/10/09. The vehicle was scheduled to arrive on 4/27/09 but it arrived on 4/29/09 with over $7000 in physical damage due to their gross negligence. I was told that DAS top loaded my vehicle on their carrier even though I did not pay the extra $150 for top loading and my vehicle was caught under a bridge overpass. If that is not gross negligence then I don't know what is. I filed a claim with DAS on 5/3/09 asking the company to refund my shipping cost so I could use that to fix my vehicle. DAS has researched this move. While we are certainly sorry that damage occured to this vehicle, there are some facts that need to be cleared up. Firstly, until such time as it is determined that the bridge was properly and accurately labeled for height, this is not a case of gross negligence. All too often, road are paved under bridges and overpasses and the height notification is not updated. Secondly, this customer specifically declined valuation coverage for their shipment in order to reduce the shipping cost. When this option is taken by the customer, it is clearly explained that any damage that occurs in transit in NOT the responsibility of DAS. This would be comparable to someone decline collision insurance on their auto policy and them blaming the insurance company for not covering their repair cost. Finally, DAS certainly wants to handle this situation as fairly and amicably as possibe. Although not legally required, we will be refunding the cost of the move to the customer as they have requested.
