Breach of Contract

Placed order based on written quote of $875 and was assured vehicle would be picked up on the day requested, within a 2-hour window. Order was placed 6 weeks prior to scheduled pickup. On the day before scheduled pickup I was informed (by Kimla) that the vehicle would be picked up "4 or 5 days later" and the price increased by $200. Considering I was in the process of moving household goods from NC to NM (I live in NM), had driven my vehicle from NM to NC (1750 miles distance) and already had a 26' Penske truck packed (on the originally scheduled date of pickup), and was given less than one day's notice that the price increased and the pickup would be 5 days later, I had little option but to accept the new price. I know it would be virtually impossible to arrange a new contract, with a different company in one day. Several days after delivery of my vehicle to NM (I deliberately waited until receipt of vehicle to make certain it was intact) I contacted Evan at Autoportation and was told that I should not have accepted the contract. To me, a contract is a promise. I accepted the original price as while it was not the lowest, it was competitive. The added $200 made it higher than all of the other quotes received. I have no complaints about the carrier, only with the broker (Autoportation). This broker should not be in business as they do not fulfill their contracts. My next communications will be to BBB and FTC with the sole intent of forcing Autoportation to fulfill their contracts.

Ron, we explicitly describe the nature of our business within our agreements which you signed. We are a broker and it is our job to assign your vehicle to a carrier. When a carrier calls us and asks for more money we can either simply tell them no and never tell you about the offer which is bad business or we can present to you their offer and give you the option to decline. Once again when Kimla presented this option to you it was something you agreed to and didn't begin to have any issues until you received the vehicle. At the end of the day our goal is to make sure your vehicle arrives safe and sound. While I do apologize for engaging in a business relationship that wasn't to your satisfaction I truly do think it's unfair for you to accept an option that we suggest and then complain excessively about our operations... To each his own and I am just happy you received your vehicle.
