Damaged Vehicle

My contract with A to Z was for two cars to be moved from NC to Texas. Everything was fine with the exception of damage done to my vehicle. J&S transport (based in NC) was the actual trucking company that picked up the contract from A to Z. The driver showed me the damage on delivery, apologized a lot and stated he did not know how it happened, thought it could have been a rock, but he just didn't know. (for what it is worth, my car was on the top because it is a soft top convertible) I asked if the damage would be covered and he stated YES and asked that I get a couple of quotes. He wrote the damage on the Bill of Lading and I signed it.

Anyway, apparently the actual cost of the repair was more than J&S expected. I guess the plan was to pay it out of pocket instead of making a claim. So, after asking for their insurance information several times I finally get a call from an insurance agent informing me that the claim will be denied because I waived my claim. She kept taking about the bill of lading and that the driver said a rock hit my car and I signed it and that is not covered under NC law.

Anyway, I got Marcus from A to Z involved in the melee and he says the same thing to me. I asked him to read to me the exact language he was referring to as I looked at my copy of the Bill of Lading. Turns out the Trucker (owner) added language right above my signature that a rock hit the car, through no fault of the Driver. If no one was the wiser the document made it appear I had agreed and signed off. Slimy. J&S states they did that for their own "notes".

Anyway, A to Z was as put off by J&S's behavior as I was. I have been told they will not use them in the future, and I have no reason to believe that is not true, but no matter who you use I would check to see if J&S picks up the contract.
