Mr. Higgins did book his car to be moved with us on 10/13/08. In doing so, he agreed to all “terms & conditions” on our website www.worryfreetransport.com . It normally takes up to 10 business days to find a truck driver to move the vehicle. We had it assigned the day it was available to BJJ Transport, a company out of St. Louis that we had used many times in the past and had nothing but rave reviews. Upon pickup the seller agreed to pay Mr. Tullock (the driver and owner of BJJ) an additional $145 because the vehicle was not running. (Normal inop fee is $150). No one called to clear this with Worry Free as both parties were in agreement. We did have trouble contacting the driver during transit, but I do not feel we can be held responsible for that as the effort was put forth and the driver could have been in an area where his phone did not have reception. We did, however, speak to Mr. Higgins or his fiancé at least 10 times per day. It is stated in our “terms & conditions” (which can be viewed on the website) that once the vehicle is picked up it is covered by the driver’s (NOT WORRY FREE’S) insurance. He did fail to mention that we voluntarily refunded his deposit although we did our part of the job. We did try to be a liaison for Mr. Higgins & his fiancé with the insurance company. Unfortunately, there was neither damage nor extra mileage noted on the signed inspection sheet (this is the first I have heard about water being added). It is CLEARLY stated on our “terms & conditions” that all damage MUST be noted on the inspection sheet in order to file an insurance claim. I do not understand how they could have been forced to sign a sheet or his car to have been hit while unloading if they had the police there. Most police officers would not stand back and allow such things to occur. We went above and beyond normal customer service trying to help Mr. Higgins & his fiancé, but given there was no documentation, our hands were literally tied. I hope Mr. Higgins gets the settlement he feels he deserves but it will have to come from the trucking company’s insurance (once again as is clearly stated in our “terms & conditions”).
