When MCAT books a load with a trucking partner they have to be in good standing within our industry as well as having a track record moving vehicles. We ensure the carriers provides us with a current cargo insurance binder and then it is confirmed on the Federal Motor Carrier website that the binder is the same info as on the site. Both the binder and the web site say the cargo insurance coverage was valid through 03-14-07. We booked the load since JDB had a history of moving vehicles with our company.
In the terms and conditions section of our agreement it clearly states that "damage claims MUST be noted on the bill of lading followed up with pictures of the damage with in 5 DAYS", this didn't happen. It also says, "Any and all damage claims must be taken up with the carrier and the carrier is solely responsible for any and all damage". In addition the terms and conditions outlines MCAT's responsibilities in the event of a damage claim, which we have followed to the letter.
Mr. Van Noord has alienated everyone in our office with his nasty phone calls and threats while we've assisted in trying to help get this damage claim resolved.
Mr. Van Noord wants to conveniently ignore the terms and conditions under which he agreed to have his car shipped and blame everyone with the exception of the actual carrier who caused the damage.
MCAT has blackballed JDB Transport from every carrying any loads for the MCAT family of brokerages as well as report him to the D.O.T. and industry officials. We've shipped thousands of vehicles over the last three years and this is the first incident like this to ever occur. We have also placed additional safe guards to "TRY" and ensure that we can never be hood winked again.
