This 2007 Ford Mustang (with over 13,000 miles) was transported by LGT Associates. This transport company has worked with us previously and we have had no problems. LGT did need to fill a spot and chose to offer our customer the opportunity to utilize their enclosed trailer for an open trailer price.
A thorough inspection was done by the driver at the pickup point and the customer signed the inspection sheet saying that she agreed with the driver's assessment of the vehicle (scratches already present on vehicle). A few days later the driver arrived and gave the customer the choice of receiving the vehicle at 10 pm that night or waiting until the next morning, as they had an additional drop in the same area. She chose to go ahead and meet the driver that night. At the delivery point, the customer, a friend of hers and the driver spent approximately 30 minutes going over the car with a flashlight and signed the condition report stating that she was receiving the vehicle free of additional damage.
She notified our office the next business day of scratches on the bumper and we instructed her to contact the trucking company directly, as her vehicle was covered under the truck driver's insurance. We did inform her that, since no additional damage was marked on the inspection report, legally our hands were tied, but that we would help her in any way possible. We supplied our customer with the transport company, name, address, phone number and motor carrier number; as well as the insurance company name and phone number.
The next day, the LGT dispatcher called to inform us that she would no longer be accepting phone calls from our customer due to the profane language and verbal abuse by our customer in telephone conversations and voicemail messages. At one point, the customer requested that the transport fees be refunded and she would let the matter drop. After many, many discussions with the driver, the dispatcher and the customer, we suggested that our customer contact the insurance company directly for an adjuster to make a determination.
Unfortunately, in a case like this, or purchases over the internet, it is impossible for the broker to know exactly what happened and who is telling the truth and who is not. We understand the frustration for all parties involved. IT IS IMPERATIVE THAT ANY ADDITIONAL DAMAGES ON A TRANSPORT BE MARKED ON THE DELIVERY INSPECTION SHEET FOR THE CUSTOMER AND THE DRIVER TO SIGN. THEN WE HAVE A LEGAL LEG TO STAND ON TO HELP WITH THE CLAIMS PROCESS.
